ANNUAL REPORT 2009

Medical Defence Malaysia Berhad is now nine years old. Over this span of time the medical negligence climate has worsened especially with the Federal Court Judgement in Foo Fio Na vs. Assunta & Anor, 2006.

Since this judgement, the claim rate has increased as the patients perceive that it is now easier to “successfully sue” doctors for medical mishaps or negligence. In addition, the quantums of court awards and out of court settlements are also increasing.

It is now vital that the indemnity provider provide risk management to its members. When MDM held its first risk management programme in November 2002 in Kuala Lumpur, the response was poor. In year 2010, MDM will again organize risk management programmes for its members in various major towns, if there is good response from our members. MDM hopes that with such programmes the incident reports and claims will be reduced in the future.

Because of the lower MDM subscriptions, specialists in the very high and high risks categories are joining MDM Bhd. This is not a healthy scenario on the longer term.

Another medical defence organisation is now identifying members with an increased medico legal risk to themselves and to the organisation. Such members are required to attend risk management “classes” at their own expense. Pending the evaluation of the outcomes of these “classes” membership may or may not be continued, and with or without loading on their subscriptions. MDM Bhd deals with such “high risk” members by not renewing their membership. New applications for MDM’s membership will not be considered if the doctors have less than 4 years postgraduate requisite training and experience. MDM also will not be providing obstetrical and gynaecological members indemnity for procedures done in “private maternity home” as defined under the Private Healthcare Facilities and Services Act 1996.

Ultimately, the success of any defence organisation rests on it having sufficient funds to defend its members. In view of the escalating court awards and out of court settlements, delay in the courts and increasing legal costs, MDM Bhd has revised its subscription rates for year 2010.

MDM has substantially increased the rates for very high risk and high risk categories. There is a moderate increase for the medium risk category. The increase for the low risk category is minimal.

Every member will be given a two percent (2%) discount per year of membership with MDM. A member is a pioneer member if he has been a member for eight years, and he will receive a sixteen percent (16%) plus five percent (pioneer status) discount. This is logical as a new subscribing member has instant access to the pool of funds contributed by those who have been MDM members for a longer period of time.

MDM often receives enquiries of membership status from our panel of advocates and solicitors. When this occurs we write to enquire from our members whether they are aware of any mishaps or medical accidents. Some of our members do not reply to our enquiry. Members are reminded to respond to our enquiries to enable us to be prepared if there is a claim. We urge members to work with us to enable MDM to serve them better.
